Terms and Conditions of Data Recovery Service

  1. THE CLIENT must provide a valid email address and phone number (landline or cell phone) in theData Recovery Form .
  2. Quotes are valid for 3 business days and to maintain a written record, quotes are sent by e-mail and must be approved or rejected by e-mail.
  3. If THE CLIENT does not retrieve their device within 15 working days of rejecting the quote, or if THE CLIENT does not contact DataRecoveryHDD.com within 5 business days after of receiving the quote, any device provided by the client will be eliminated and any obligation by DataRecoveryHDD.com towards the client will be considered extinct.
  4. The device in which the recovered information will be stored must be delivered the same day a the budget approval (for express mode) and in no more than 72 hours for normal mode. Failure to provide it within this time period will result in the case being rejected.
  5. DataRecoveryHDD.com is not responsible for the devices or data contained in the devices provided by THE CLIENT for the storage of the recovered information.
  6. If THE CLIENT does not provide a donor drive within 45 calendar days of being notified being requested, any device provided by the client will be eliminated and any obligation of DataRecoveryHDD.com towards the client will be considered extinct.
  7. If the CLIENT does not collect the recovered information within 5 working days of being notified of a successful recovery, only the device provided by the client to store the recovered information will be retained. Any other device provided by the client and any copies of the information on our servers will be eliminated. In these cases THE CLIENT is still responsible for 100% of the approved quote.
  8. If the CLIENT does not collect the device that was supplied to store the recovered information within 30 calendar days of being notified of a successful recovery, the device will be removed and any obligation by DataRecoveryHDD.com towards the client will be considered extinct.
  9. Device withdrawal: A minimum of 48 hours is required after rejecting the quote before THE CLIENT can collect their device so that it can be reconditioned. Likewise, if the client wants to keep donor devices, patients, implements, etc, this must be notified in the approval of the budget.
  10. Normal Service: The diagnosis takes a maximum of 3 business days and is free upon approval of the quote; the diagnosis in cases in the contrary have a cost of US$30.
  11. Express Service: The diagnosis has a cost of $50 which is non-refundable.
  12. The Data Recovery Service of a device that has been overwritten is paid in full and in advance (for both normal and express services).
  13. The CLIENT declares to know that the repair of the device implies unavoidable loss of the data of the same.
  14. In cases where THE CLIENT can not personally deliver the device to DataRecoveryHDD.com, the device must be sent to the address of DataRecoveryHDD.com by THE CLIENT´s choosen means. DataRecoveryHDD.com does not assume responsibility for logistics to and from the company.
  15. When the work contracted in the quote becomes impossible by circumstances out of the companies control (for exmple: natural disaster) directly impacting the device on which the service has been contracted, DataRecoveryHDD.com is exempt from its compliance, and the obligation is considered to be extinguished with the return of a device with the same characteristics as the one delivered by THE CLIENT.
  16. Payment is cash, for cases where payment by transfer or bank deposits applies, the information will be provided after the amount is invoiced..
  17. The prices are subject to the adjustments at the discretion of DataRecoveryHDD.com if not paid within 5 working days of receiving the budget.
  18. Once THE CLIENT approves the quote they may change their mind, for any reason, however they will still be responsible for 70% of the original quote for the contracted services they approved.
  19. The CLIENT declares to know that both the diagnosis and the recovery process at times can require destructive methods and/or the altering of the conditions of the hard drive, which may void the factory warranty of the hard drive and/or the hard drive could become unusable.
